LOT Polish Airlines filed a lawsuit in Seattle, United States against Boeing. The Polish transport company demands compensation of at least 1 billion zlotys – the Polish news agency reported, citing an anonymous source. The case relates to design flaws in the 737 Max that caused it to be grounded.

The information was confirmed on Tuesday by PLL LOT press spokesperson, Krzysztof Moczulski.

As the source told PAP, the lawsuit was preceded by many months of settlement negotiations, which did not lead to satisfactory solutions.

The source told PAP: “LOT Polish Airlines has filed a lawsuit in Seattle, Washington against Boeing. The company is seeking compensation of at least 1 billion PLN (US$250 million).” The case is said to be linked to “flaws in the design of the 737 Max that led to its decommissioning”.

PLL LOT and Boeing negotiations

The head of LOT Polish Airlines, Rafael Melczarski, in an interview with journalists at the beginning of October this year. He admitted that the company suffered huge losses when it came to grounding the Boeing 737 Max.

“We are in talks and talked with Boeing. So far, these talks have not brought the expected results, so we will use the available solutions to obtain compensation” – Milcharsky said at the time.

He added: “We will not give up anything that Boeing owes us. It is normal and we will make such allegations against Boeing.”

Boeing 737 Max aircraft were grounded by EASA (European Union Aviation Safety Agency) on March 12, 2019, after two accidents with these machines – in Indonesia in October 2018 and in Ethiopia in March 2019, killing 346 people in total.

Boeing’s 737 Max jets returned to flights around the world at the start of the year after a nearly two-year hiatus to repair faulty systems. In March, LOT Polish Airlines joined 15 airlines that resumed flights with the 737 MAX.

The first cruise, after a break of more than two years, flew from Warsaw to Oslo, to mark the return to flights with this type of aircraft. Then the carrier confirmed that before the flight with passengers, each of the machines underwent the modifications required by the flight regulator EASA.

Each of LOT’s five B737 MAX aircraft can accommodate up to 186 passengers.
