Santander Polska Bank It is the first bank to be accused by the head of the Competition and Consumer Protection Office of not paying the fees imposed in the event of full early repayment of the mortgage loan– The Office of Competition and Consumer Protection announced in a statement today, Wednesday.
The bureau stated that in May of this year, the head of UOKiK initiated 17 declaratory lawsuits against banks in connection with indications from consumers about the problems of settlement of the cost of mortgages in the event of early repayment.
“The bureau found that Santander Bank received numerous complaints from consumers who paid off their mortgage loans early, from July 22, 2017 to May 16, 2022. Previous results of the UOKiK chief showed that the bank is looking at such claims negatively, the bureau announced. .
UOKiK noted that due to the increase in interest rates WIBOR 3M and 6M, which determine the interest rate on mortgage loans in PLN, mortgage loan payments made by consumers are increasing.
“This is why some clients decide to pay off their loans early. In such a case, the bank must settle accounts with the borrower and return the proportionally charged fees that constitute the total cost of the loan, regardless of when they were incurred.– explains the office.
As added, billing for accounts collected by the bank is subject to, among other things, commissions and brokerage or contract preparation costs. It should be remembered that this rule applies to contracts concluded after July 21, 2017. In the case of previously obtained mortgage loans, the issue of early repayment is regulated by loan agreements.
UOKiK stated that the possibility of early repayment or overpayment of a mortgage loan is caused by the Mortgage Loans Act and the supervision of mortgage brokers and agents, and the obligation to settle accounts with the consumer is also caused by this law.
UOKiK has reported that UOKiK Chairman Santander Bank Polska has been accused of implementing a practice that violates the collective interests of consumers.
“The claim relates to clients who have not paid their mortgage in full before the deadline, the amount owed to them in such cases. I would like to remind you that in case of early repayment, banks are obligated to settle accounts with borrowers. This settlement must cover all loan costs. “In our opinion, it is the result of applicable legal regulations,” UOKiK President Thomas Crostini said in the announcement.
As pointed out by the UOKiK president, these provisions are similar to consumer loans, where banks initially firmly questioned the office’s actions, but finally complied with the 2019 CJEU ruling and UOKiK’s president’s guidelines.
“Fee bills should be based on the simplest and fairest straight-line method. In the explanatory proceedings, we are also looking at the practices of other banks and do not rule out further accusations,” Krustney emphasized.
According to the bureau, Santander Bank Polska could be fined up to 10 percent for violating collective consumer interests. annual yield.
